“Orders From Above Won’t Save You” — Lawyer Njiru Warns Police After Arrest Saga

Nairobi-based lawyer Ndegwa Njiru has issued a strongly worded statement targeting officers from Kasarani Police Station, days after his controversial arrest along Thika Road.


In a direct address to Inspector Nancy Chemelil Mwaura and two officers involved in the incident, Njiru signaled imminent legal action, accusing them of acting on unlawful instructions. 


“The petition is now marinating and simmering. Let’s stretch the limits of our Constitution,” he wrote, indicating plans to challenge the arrest in court.

Central to Njiru’s statement is his claim that one of the arresting officers admitted they were acting under external directives. He singled out Police Constable Geofry Cheriyot, recalling a moment during the arrest.


“PC Cheriyot, you remember the answer you gave to me when I inquired why you’re arresting me… you said they were orders from above?” Njiru stated.


He questioned the legality of such instructions, warning that those responsible would be held individually accountable. “Let’s now see how those orders from above will bail you out. We meet in court. Jitayarisheni,” he added.


Background to the Arrest

Njiru was arrested on the night of July 8 along Thika Superhighway after his vehicle reportedly stalled, with police initially accusing him of obstruction. 


The situation escalated after officers suggested additional allegations, including driving under the influence—claims he denied.


He was later presented at the Milimani Law Courts, but released without charge after the Office of the Director of Public Prosecutions declined to approve the case.


Legal and Political Implications

The lawyer’s latest remarks point to a potential constitutional petition that could test the limits of police authority and command responsibility within the National Police Service.
