The Office of the Director of Public Prosecutions (ODPP) has approved murder charges against students implicated in the Utumishi Girls Academy arson incident that claimed multiple lives in Nakuru County.
In a statement issued by its Public Affairs and Corporate Communication Division, the ODPP confirmed that it had received and reviewed a preliminary inquiry file from the Directorate of Criminal Investigations (DCI) relating to the tragic fire that occurred on 28 May 2026.
After assessing the evidence, the Director of Public Prosecutions sanctioned charges against the suspects, who will now face 16 counts of murder linked to the incident.
The ODPP noted that the decision was made following careful consideration of investigative findings submitted by law enforcement agencies.
The office expressed concern over what it described as a growing number of arson cases and related criminal conduct within educational institutions across the country.
It cautioned students and members of the public that anyone found culpable in such offences would be held accountable under the law.
“The Office of the Director of Public Prosecutions wishes to caution that individuals found culpable of such criminal offences will be prosecuted in accordance with the law,” the statement read in part.
The ODPP also extended condolences to the families of the victims, the school community, and all those affected by the tragedy, describing the incident as deeply painful and distressing.
It reaffirmed its commitment to ensuring justice is served through a fair and evidence-based prosecution process.
Further, the prosecution office reiterated its constitutional mandate to uphold the rule of law, protect public interest, and ensure accountability in all cases where criminal conduct is established.
The case is expected to proceed to court once formal charges are filed, marking a significant step in one of the most serious school-related arson prosecutions in recent years.
