The Office of the Director of Public Prosecutions (ODPP) has secured a 28-year prison sentence against a Thika-based Deputy Headteacher found guilty of defiling a 13-year-old pupil.
Mr. John Kamau Wachiuri, who served at a private school, was charged under Section 8(1) read with Section 8(3) of the Sexual Offences Act.
During the trial, evidence showed that he abused his position of trust and authority to commit the offence within the school premises.
The case took an unusual turn on the scheduled judgment day, 27th February 2025, when Mr. Wachiuri failed to appear in court.
Despite multiple mentions and repeated attempts by the prosecution to secure his attendance, the Deputy Headteacher remained at large.
In response, the prosecution moved the court on 3rd December 2025, seeking to have the accused sentenced in absentia.
Senior Resident Magistrate Hon. D. Milimu approved the request, stressing that evading court cannot shield an offender from justice. Consequently, Mr. Wachiuri was convicted and sentenced to 28 years’ imprisonment in absentia.
The prosecution team, led by Ms. Grace Emisiko and Ms. Edna Sudi, hailed the ruling as a strong message against sexual offences in schools, emphasizing that perpetrators will face the full force of the law, even if they attempt to flee.
The ODPP called on members of the public and school administrators to remain vigilant and report any suspicious conduct to protect children from abuse.
This case marks a significant step in enforcing accountability for educators who exploit their positions, reinforcing Kenya’s commitment to safeguarding minors against sexual exploitation.
