A fresh legal debate has emerged following a High Court ruling that placed Kenya’s next presidential election in 2026, with city lawyer Peter Wanyama strongly opposing the interpretation and insisting the Constitution supports a 2027 poll.
In a recent judgment, Justice Mugure Thande ruled that the next presidential election should be held on Tuesday, August 11, 2026, interpreting the Constitution to require voting on the second Tuesday of August in the fifth year after the last General Election on August 9, 2022.
The court held that the fifth year begins in August 2026.
But Wanyama has dismissed that interpretation, arguing that it contradicts both constitutional logic and basic counting of a five-year presidential term.
“A president is elected for a term of five years. Let us count,” Wanyama said, laying out a year-by-year breakdown from August 2022 to August 2027.
He argued that the fifth year runs from August 2026 to August 2027, meaning the election should fall in August 2027.
According to him, the Constitution must be read in a way that respects the full five-year tenure, rather than truncating it.
“Election of the President should be held on the second Tuesday of August of the fifth year, which is August 2027,” he stated.
Wanyama also criticised the court’s reasoning, framing his argument around logic and mathematical precision.
“Mathematics is transcendental… the interpretation of the Constitution requires logic, not interference. Simply count it,” he said.
The disagreement underscores a widening split among legal minds over the interpretation of Article 136(2)(a), which sets the election date.
While the High Court’s position anchors the timeline at the start of the fifth year, opposing views—like Wanyama’s—place emphasis on the completion of five full years.
Despite the ruling, its immediate effect was halted. Justice Thande suspended the declaration to allow time for appeals and to prevent disruption of the electoral calendar.
The decision leaves the Independent Electoral and Boundaries Commission (IEBC) operating under the current 2027 timeline, pending further judicial direction.
