A fresh High Court ruling has revived debate over Kenya’s constitutional election timeline, after lawyer Willis Otieno said the court’s interpretation aligns with a position he has advanced for months.
In a decision delivered at the High Court in Malindi, Justice Mugure Thande declined to support attempts to alter the country’s election timetable through the courts, effectively maintaining the current electoral framework.
While the ruling upheld the constitutional calendar as it stands, it has also triggered renewed legal discourse on how the Constitution should be interpreted regarding election dates.
Reacting to the development, Otieno said the ruling reflects a strict reading of the Constitution, particularly on provisions governing presidential election timelines.
“For months, I maintained that the Constitution, properly interpreted, points to a presidential election in August 2026. Many dismissed the argument without engaging the constitutional text,” he said.
Otieno added that the court’s position demonstrates that constitutional interpretation must be grounded in legal analysis rather than public opinion.
“Today, Justice Mugure Thande of the High Court at Malindi has reached the same constitutional interpretation. This is a reminder that constitutional questions are resolved through rigorous legal analysis, not popular opinion or repetition,” he stated.
The lawyer further noted that his stance was not about personal validation, but about adherence to constitutional principles.
“I feel vindicated not because a court agreed with me, but because fidelity to the constitutional text ultimately prevailed over assumption. The Constitution remains the supreme law, and its meaning must always be derived from its words,” he said.
Despite Otieno’s interpretation, the court did not issue orders to change the scheduled election date, instead affirming that any alteration to the electoral calendar must follow established constitutional and legal processes.
