Magistrate’s Court over an alleged Sh69 million gold scam, in a case that had stalled after his failure to appear in court last year.
The Directorate of Criminal Investigations (DCI) confirmed the arrest of Alphonce Collins Odoyo Osewe, an advocate of the High Court of Kenya, who had been on the run after skipping court summons.
“An advocate of the High Court of Kenya who had been on the run after failing to appear in court to answer charges linked to an alleged Sh69,024,800 gold scam has been arraigned before the Chief Magistrate’s Court at Milimani,” the DCI said in a statement.
Detectives from the DCI Nairobi Regional Office apprehended the suspect within the precincts of the Milimani Law Courts, acting on a warrant of arrest issued by the court.
“The suspect, Alphonce Collins Odoyo Osewe, was arrested by detectives from the DCI Nairobi Regional Office within the precincts of the Milimani Law Courts pursuant to a warrant of arrest issued after he failed to honour court summons,” the statement added.
According to the prosecution, Osewe is accused of defrauding a complainant of Sh69,024,800 by falsely claiming he could facilitate the sale of gold bars in collaboration with an accomplice.
“He is charged with obtaining money by false pretences, contrary to Section 313 of the Penal Code. It is alleged that he jointly obtained Sh69,024,800 from a complainant by falsely pretending that he and an accomplice were in a position to sell gold bars,” DCI stated.
Court records indicate that the suspect had failed to appear before the same court on October 23, 2025, to take plea, prompting the issuance of a warrant of arrest and forfeiture of previously deposited cash bail.
“The warrant of arrest was issued after the suspect failed to appear before the Chief Magistrate’s Court at Milimani on October 23, 2025, to take plea, leading to the forfeiture of the cash bail previously deposited,” the agency noted.
Upon arraignment, Osewe pleaded not guilty to the charges. The court ordered that he be remanded in custody pending the determination of his bail application.
