Harrison Nyende Mumia, president of the Atheist Society of Kenya, was arraigned at Milimani Law Courts on Monday over allegations of publishing false information against state leadership.

The Directorate of Criminal Investigations (DCI) revealed that Mumia allegedly used a pseudo Facebook account under the name Robinson Kipruto Ngetich to circulate misleading statements on December 30, 2025. 

Authorities say the posts were intended to misinform the public about government activities.

During his arrest, detectives confiscated several items from Mumia’s Kangundo Road residence. 

Among the items seized were two company stamps linked to Dovty Digital Technologies and the Atheists in Kenya Society, an HP EliteBook X360 laptop, a Redmi smartphone, and other electronic devices. 

The DCI indicated these items could be crucial for ongoing investigations.

Mumia appeared before the court facing four counts of publishing false information under Section 22(1) of the Computer Misuse and Cybercrimes Act No. 5 of 2018. 

He pleaded not guilty. The court set his bail at Sh1 million with one contact person, or Sh500,000 with two contacts, and ordered him to deposit his passport.

The case is scheduled for mention on January 19, 2026, as investigators continue to examine the scope of the alleged false publications.

The arrest has stirred discussion online, with some critics questioning the balance between freedom of expression and the enforcement of cybercrime laws. 

The DCI, however, emphasized that the action aims to curb the spread of false information that could undermine public trust in government institutions.

Mumia’s prosecution is part of a broader government effort to enforce the Computer Misuse and Cybercrimes Act, which has been used increasingly to monitor social media content and hold individuals accountable for circulating misinformation affecting public affairs.
