"History Is Unkind to Quitters" Nyamira Senator Blasts Havi for Giving Up on Fighting For Nairobi Hospital Amid Scandals

Nyamira Senator Okongo Omogeni has criticised Senior Counsel Nelson Havi for stepping back from legal action aimed at tackling governance and corruption issues at The Nairobi Hospital (TNH). 

Havi had announced that he was abandoning his efforts, saying powerful individuals in the government were undermining the hospital.

“To abandon a public cause because the road is hard is not prudence; it is abdication. In ancient Athens, Solon warned that injustice thrives when good men retreat into silence,” Omogeni said on Sunday. 

He added that justice is bigger than any one advocate.

Havi’s retreat comes after TNH has faced intense scrutiny over financial mismanagement, boardroom disputes, mass staff layoffs, and conflicts with insurers. 

A recent forensic audit led to the dismissal of over 200 employees, exposing weaknesses in internal controls and raising concerns about hospital governance.

Omogeni warned that quitting legal battles sends the wrong message. 

“Law is not a solo crusade nor a stage for fatigue-driven theatrics. If the guardians of jurisprudence tire, they should step aside without theatrics. Nairobi Hospital will not be saved by despair. History is unkind to quitters who mistake withdrawal for wisdom,” he said.

The senator urged lawmakers, regulators, and civil society to maintain pressure on the hospital’s management to ensure accountability and transparency. 

He also highlighted that TNH’s challenges reflect wider problems in Kenya’s healthcare sector, where private institutions play a key role in public access to quality services.

Omogeni’s intervention has reignited public debate on whether powerful institutions and individuals can be held to account and whether legal and civic action can succeed despite entrenched interests.
