When Justice Misfires: The Toll of Wrongful Accusations

Kenya’s job market remains tight for university graduates, with the Kenya National Bureau of Statistics reporting persistently high rates of youth unemployment. 


Experts in labour economics say limited job opportunities increase vulnerability to informal work and legal marginalisation, especially when individuals lack financial resources and legal literacy. 


Legal professionals also warn that wrongful accusations in civil and commercial disputes can have devastating consequences for young people with unstable incomes, trapping them in prolonged court battles and exacerbating mental stress.


Kamau's Story;


“I graduated from university full of hope, believing life would finally start moving in the right direction. Like many young people, I dreamed of building a career and supporting my family. But months turned into years, and despite sending countless job applications, I remained unemployed.


To survive, I took small temporary jobs around town—helping with deliveries or assisting in local shops—just to cover daily expenses. Life was difficult, but I tried to stay hopeful. Then the biggest shock of my life came: I was suddenly accused of something I had never done.


A local businessman claimed I had been involved in a fraud case connected to his company. I was completely confused because I had never even worked for him. 


Yet somehow, my name had been dragged into a legal dispute over money. Before I knew it, the matter had reached court.


The situation was terrifying. I had no stable job, very little money, and suddenly I needed legal representation. I spoke to several lawyers, hoping someone would help me prove my innocence. 


Unfortunately, many looked at the documents and told me the case was too complicated, and my chances of winning were very small. Hearing that nearly broke my spirit. I felt as if my life was collapsing before it had even begun.


My family tried to encourage me, but the pressure was overwhelming. One evening, while waiting for a bus, I met an old classmate I hadn’t seen since graduation. 


After we greeted each other, I decided to tell him everything about the court case and how hopeless it felt. He listened carefully and shared that he had once faced a serious personal challenge and had received guidance that helped him gain clarity.


That conversation stayed with me. I realized I had nothing left to lose, so the next day I sought guidance from someone experienced in navigating such difficult situations. 


I explained the accusations, the court case, and how even lawyers believed the case could not be won. I was advised to remain calm, gather all relevant information, and approach the legal process with a clear mind.


With renewed determination, I continued attending court hearings and working closely with the lawyer who had finally agreed to represent me. 


Slowly, new details emerged that exposed weaknesses in the accusations against me. Several months later, the court ruled in my favor. The accusations were dismissed after evidence proved I had been wrongly implicated.


I could hardly believe it when the decision was announced. The relief I felt is something I will never forget. That guidance and encouragement helped me remain strong when I was ready to give up.
